The federal Crime Victims’ Rights Act defines a victim as “a person directly and proximately harmed” by a federal offense. This language is being litigated nationwide. Examples: Is a shooting victim also the “victim” of the person who illegally sold the gun to the shooter? Is a person who becomes addicted to a drug a “victim” of the drug company being prosecuted for illegally marketing the drug as non-addictive? This workshop will discuss the language, these and other case examples, and propose a legal test for courts to apply.
