In some jurisdictions, victims’ rights attach pre-charging, meaning that victims have rights during the investigation phase of a criminal case. Rights that may attach: the right to information, the right to protection, and the rights to dignity, fairness and respect. This workshop will address complex questions such as: Are these rights enforceable? What can a victim do if the prosecutor decides not to charge a crime? What happens when charging does occur but the victim is no longer a “victim” because the charge does not include him or her?
